Hillsdale Water Quality Project Landowner Agreement

Each undersigned person (landowner(s)/legal agent) agrees to the following terms set forth herein by the regulations governing the Hillsdale Water Quality Project Inc. Cost-Share Program for Demonstration Practices.

  1. All structures/practices receiving financial assistance from the Hillsdale Water Quality Project Inc. are to be built to Kansas Field Office Technical Guide Standards and Specifications. Where Kansas Field Office standards and specifications do not exist, Hillsdale Water Quality Project Inc. can approve minimum control practices.
  2. This contract shall expire on the date established by the Hillsdale Water Quality Project Inc., and may be canceled, unless Hillsdale Water Quality Project Inc. extends the contract expiration date for the following reasons:
  1. A valid effort has been shown to complete the project, or
  2. A written or verbal landowner request for an extension approved by the Hillsdale Water Quality Project
  1. Actual cost of the practice will be used as the basis for determining the amount of financial assistance provided.
  2. As a condition of accepting Hillsdale Water Quality Project Inc. cost-share assistance, I agree to maintain the practice according to recommended maintenance procedures for 10 years or the life of the practice. Should I fail to maintain the practice according to the Kansas Field Office Technical Guide Standards and Specifications, it is understood that I will be required to pay back cost-share funds received on a pro-rata basis and may be declared ineligible for future cost-share funds. Where Kansas Field Office Technical Guide Standards are not available, maintenance procedures will be developed by the Project.

Grazing Lands served by practices such as ponds and fencing shall be maintained in permanent vegetation for a minimum of 10 years.

  1. When a change of ownership occurs on land before the expiration of the practice lifespan specified, it is the responsibility of the cost-share recipient to obtain, in writing, an agreement with the new owner to transfer the maintenance obligations as stated in the Landowner Agreement to the new landowner. A copy of the maintenance agreement transfer shall be provided to the Hillsdale Water Quality Project. If such an agreement is not made, this Landowner Agreement shall remain binding with original landowner who signed this agreement and received the cost-share assistance.
  2. Since the financial assistance is being provided for a demonstration practice I will
  1. allow people to come onto my property, with permission, to observe the practice,
  2. have a sign posted at the demonstration project, provided by the Project,
  3. serve as a resource to others interested in using the practice
  4. provide access for sampling or other monitoring
  5. maintain records
